As an employer, you can apply for an exception to Sunday or holiday work:

• if you need to employ workers to meet daily or special needs of the population.
• Special needs exist when goods or services are perceived as important on a daily basis by a significant portion of the population. In addition, the absence must be perceived as a shortage.
• Wighly desirable goods and services are not sufficient to qualify for an exemption.

You may also request an exception if an interruption or postponement of work:

• is not possible.
• is only possible with considerable difficulty.
• there are particular dangers to the life or health of the employees.
• leads to considerable burdens on the environment, energy or water supply.
• secures employment.
• protects the common good.

Verfahrensablauf

If you want to apply for the exception for Sunday and holiday work in writing: Complete the relevant application form in full. Send this to the locally competent authority, including the documents listed in the application. If the required documents or information are incomplete for processing, you will be contacted by the clerk. If the requirements for approval are met, you will receive a notice of approval; otherwise, you will receive a notice of rejection. The locally responsible authority will send you the notice by e-mail or by post. The fee notice will usually be sent to you later. If you wish to apply for the Sunday and holiday work exception online, the following steps must be taken: Access the online service. Fill in the fields of the online service completely and send it to the locally competent authority for occupational health and safety,including the documents and evidence listed in the application. If any required documents or information are incomplete for processing, you will be contacted by the clerk. Dhe locally competent authority will review the application. If the requirements for approval are met, you will receive a notice of approval, otherwise a notice of rejection. T he decision will be sent to you by e-mail or by post. The fee notice is usually sent to you later.
